These Terms of Service (“Terms”) govern access to and use of thebedroomstor.com and purchases made through the website. Please read them before using the website or placing an order.
1. Merchant and Contracting Seller
This website and online store are owned and operated by Roger Stephen Hildick, an individual sole proprietor located in Illinois, United States. “The Bedroom Stor” is the storefront name used by Roger Stephen Hildick. It is not a separate legal entity.
Roger Stephen Hildick is the seller and contracting party for every purchase made through thebedroomstor.com.

In these Terms, “The Bedroom Stor,” “we,” “us,” and “our” refer to Roger Stephen Hildick in his capacity as the website operator and seller.
2. Acceptance of These Terms
By accessing the website, creating an account, or placing an order, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use the website or place an order.
Nothing in these Terms excludes or limits a mandatory consumer right that cannot lawfully be excluded or limited.
3. Eligibility and Customer Accounts
You must be at least 18 years old or the age of legal majority in your place of residence to place an order. A minor may use the website only under the supervision of a parent or legal guardian who accepts responsibility for the use.
If you create an account, you are responsible for providing accurate information, protecting your login credentials, and notifying us promptly of suspected unauthorized use. We may suspend an account when reasonably necessary to protect the customer, the website, or other users from fraud, abuse, or a security threat.
4. Product Information
We make reasonable efforts to provide accurate product titles, descriptions, photographs, dimensions, materials, colors, features, compatibility information, safety information, prices, and availability.
Product colors and textures can appear differently because of screen settings, lighting, photography, natural material variation, or manufacturing batches. Wood grain, stone pattern, fabric texture, leather markings, and handmade finishes can vary naturally. A natural variation is not a defect when it is consistent with the product description and reasonable expectations for that material.
Dimensions and weights are stated using the measurement shown on the product page and can be subject to minor manufacturing tolerances. Customers should review all dimensions, package sizes, access requirements, weight limits, assembly requirements, care instructions, and safety warnings before ordering.
Product-specific information on the product page, packaging, label, manual, or manufacturer documentation forms part of the product information and takes priority over general website descriptions where it is more specific.
5. Availability
Products are offered subject to availability. Adding a product to a cart does not reserve it. If an ordered product becomes unavailable before acceptance or shipment, we will notify the customer and refund every amount collected for that product.
A product is available for delivery to a country only if the product page and checkout permit delivery to the selected address. Products lacking the product-safety information required for sale in a destination must not be offered for delivery to that destination.
6. Placing an Order and Contract Formation
By selecting the order button at checkout, the customer submits an offer to buy the products in the cart at the displayed total and confirms that the order creates an obligation to pay.
An automated order-receipt email confirms that we received the order; it does not by itself guarantee acceptance or availability. The contract is formed when we send an order-acceptance or shipping confirmation, unless checkout expressly states that acceptance occurs earlier under the law applicable to the customer.
We can request reasonable payment, identity, fraud, address, or delivery verification before accepting an order. We can reject or cancel an order before shipment when:

payment is declined, unauthorized, or cannot reasonably be verified;

the product is unavailable;
-
the delivery address is incomplete, unsupported, or outside carrier coverage;

the order contains an obvious pricing or listing error that a reasonable customer would recognize;

the quantity indicates unauthorized resale or exceeds an expressly stated limit;
-
fulfillment would violate law, a product-safety restriction, a sanctions requirement, or a carrier restriction; or
-
credible evidence indicates fraud, abuse, or misuse of the website.
If we cancel after capturing payment, we refund the amount collected for the cancelled product and its applicable delivery charge to the original payment method. We do not substitute a different product without the customer’s express agreement.
7. Prices, Currencies, Taxes, and Payment
We accept Visa and Mastercard cards. The customer authorizes the payment provider to charge the displayed order total to the selected card.
The product page, cart, and checkout show the applicable market currency. Before the order is submitted, checkout shows the product price, discount, shipping charge, taxes collected by us, import charges collected by us, and total amount payable to us.
For consumer orders delivered to Belgium, Finland, France, Germany, Hungary, Italy, the Netherlands, Poland, or Spain:

displayed product prices include applicable VAT;

VAT applicable to standard shipping is included in the displayed shipping charge;

we arrange and bear applicable import VAT, customs duties, ordinary customs-clearance charges, and brokerage charges necessary for delivery; and
-
the customer is not required to pay an additional import VAT, customs duty, ordinary clearance charge, or brokerage charge at or after delivery.
United States sales tax is calculated and collected at checkout where required. Treatment of taxes and import charges for Switzerland and Türkiye is stated in the Payment, Pricing, Taxes and Duties Policy.
We do not charge a fee solely for using Visa or Mastercard. A card issuer can separately charge its own currency-conversion, international-transaction, overdraft, or account fee under its agreement with the cardholder.

8. Shipping and Delivery
Orders ship from the United States. Available countries, processing times, delivery estimates, product shipping classes, shipping charges, customs treatment, freight terms, tracking, failed-delivery rules, and delivery restrictions are stated in the Shipping Policy.
Delivery dates are good-faith estimates unless we expressly confirm a guaranteed date in writing. A delay does not remove any mandatory right relating to late or failed delivery.
Where we select the carrier, risk of accidental loss or damage remains with us until the customer or a third party designated by the customer, other than the carrier, takes physical possession of the goods, except where applicable law provides otherwise.
The customer must provide a complete and accurate delivery address and should verify that packaged furniture can pass through doors, elevators, stairs, hallways, and other access points. Standard delivery does not include assembly, installation, wall mounting, room-of-choice service, removal of old furniture, or removal of packaging unless the product page or checkout expressly includes that service.
9. Order Cancellations
An unshipped order can be cancelled under the conditions in the Cancellation Policy. There is no cancellation fee for an order that we successfully cancel before shipment.
If the order has already shipped, the customer can use an applicable return or withdrawal right after delivery. EU consumers retain the separate statutory right of withdrawal described in the EU Right of Withdrawal Policy.
10. Returns, Refunds, and EU Withdrawal
Eligibility, procedures, condition requirements, return costs, exclusions, refund amounts, refund timing, and remedies for damaged or non-conforming goods are stated in the Return and Refund Policy.
EU consumers have a separate statutory 14-day right of withdrawal for eligible distance purchases. That right, its exceptions, the model withdrawal form, return-cost rule, and reimbursement deadline are stated in the EU Right of Withdrawal Policy.
No voluntary return condition limits a mandatory remedy for goods that are damaged, defective, unsafe, incorrect, or not in conformity with the contract.
11. Legal Guarantees, Product Issues, and Commercial Warranties
The seller is responsible for mandatory legal remedies that apply to damaged, defective, incorrect, unsafe, or non-conforming goods.
EU consumers have at least the minimum legal guarantee required by applicable EU and national law. This legal guarantee is separate from the 14-day withdrawal right and from any voluntary 30-day return offer.
We do not provide an additional store commercial warranty unless a product page or written warranty document expressly states one. A manufacturer warranty, when offered, is additional to and does not replace mandatory consumer rights.

12. Product Safety, Assembly, and Recalls
Customers must follow product-specific warnings, assembly instructions, care instructions, weight limits, electrical instructions, anchoring instructions, and other safety information.
Furniture must be assembled, installed, anchored, maintained, and used only as intended. Dressers, cabinets, bookcases, shelving, wardrobes, and other tip-prone furniture must be secured when instructions or foreseeable safe use require it. Children must not be allowed to climb, hang from, or play on furniture.
If a product appears unsafe, stop using it and contact us immediately. Recall and safety-notice procedures are stated in the Product Safety and Recall Policy.
13. Promotions and Pricing Errors
A promotion is governed by the eligibility, dates, exclusions, and other conditions displayed with it. Unless the promotion expressly states otherwise, it cannot be combined with another offer or applied retroactively.
If an obvious technical or pricing error occurs, we will contact the customer before shipment. Where cancellation is lawful, we can cancel the affected item and refund all amounts paid for it. This does not permit cancellation merely because a valid accepted price later becomes less favorable to us.
14. Reviews and Customer Content
If a customer voluntarily submits a review, photograph, video, question, comment, or other content, the customer confirms that the content is accurate, lawful, based on genuine experience where represented as a review, and does not infringe another person’s rights.
The customer grants us a non-exclusive, worldwide, royalty-free license to host, reproduce, format, translate, and display the submitted content for operation and promotion of the store. This license does not transfer ownership of the content and ends when the content is deleted from our systems, except for copies lawfully retained for security, legal, or backup purposes.
We can decline or remove content that is unlawful, fraudulent, abusive, irrelevant, contains personal data that should not be public, or violates another person’s rights. We do not suppress a genuine negative review solely because it is negative.
15. Intellectual Property
Website text, graphics, logos, layout, photographs, videos, and other content are owned by or licensed to us or their respective rights holders. The website may be used for personal, non-commercial shopping purposes.
Except where law permits, no person may copy, republish, sell, scrape, exploit, alter, or distribute website content for commercial use without written permission from the relevant rights holder.
16. Prohibited Uses
The website must not be used to:

violate law or another person’s rights;

submit false, fraudulent, or misleading information;

interfere with security or normal operation;

introduce malware or harmful code;
-
attempt unauthorized access to an account, system, or data;

conduct abusive automated scraping or excessive requests;

impersonate another person or misrepresent affiliation; or

facilitate payment fraud, chargeback abuse, or unlawful resale.
17. Third-Party Services and Links
The store uses Shopify for ecommerce hosting and checkout and uses service providers for payment processing, fraud prevention, shipping, customs, customer communications, analytics, and other operational functions. A third-party service can be governed by its own terms and privacy notice when the customer directly uses that service.
Links to third-party websites are provided for convenience. We are not responsible for independent third-party content or services, but this does not limit responsibility that cannot lawfully be excluded.
18. Website Availability
We take reasonable steps to keep the website available and accurate. Temporary interruption can occur for maintenance, security, updates, technical failure, or events outside our control. We do not guarantee uninterrupted access, but an interruption does not affect a contract already formed or a mandatory customer right.
19. Disclaimers and Limitation of Liability
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where it cannot be limited, defective-product liability that cannot be excluded, or any mandatory consumer right.
To the extent permitted by law, we are not liable for an indirect or consequential business loss arising from a consumer purchase, including loss of profit, revenue, business opportunity, or data, when that loss was not reasonably foreseeable at the time the contract was formed.
For a customer acting in the course of business, and only to the extent permitted by law, aggregate liability arising from an order is limited to the amount paid for the product giving rise to the claim. This limitation does not apply to liability that cannot lawfully be limited.
20. Events Outside Reasonable Control
We are not responsible for a delay caused by an event outside reasonable control, including severe weather, natural disaster, strike, carrier disruption, customs action, war, civil disorder, government action, epidemic, infrastructure failure, or widespread system outage. We will take reasonable steps to reduce the effect, communicate a material delay, and perform when possible. Mandatory rights relating to delivery, cancellation, or reimbursement remain unaffected.
21. Governing Law and Disputes
These Terms and contracts made through this website are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law principles.
If the customer is a consumer outside the United States, this choice of law does not deprive the customer of mandatory consumer protection provided by the law that applies in the customer’s country of habitual residence. A consumer can bring a claim in any court available under mandatory applicable law, including the courts of the consumer’s habitual residence where that right applies.
Before filing a claim, customers are encouraged to contact info@thebedroomstor.com so we can attempt to resolve the matter. This informal step does not shorten a limitation period or restrict access to a court, regulator, supervisory authority, or mandatory dispute-resolution process.
22. Severability, No Waiver, and Assignment
If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect.
Failure to enforce a provision once is not a waiver of the right to enforce it later.
We will not transfer a consumer contract in a manner that reduces the consumer’s rights. A customer cannot transfer an order or contractual right without our agreement, except where law permits.
23. Changes to These Terms
We can update these Terms for future website use or future orders. The revised Terms will be posted with a new “Last updated” date. The version accepted when an order was placed continues to govern that order unless a change is required by law or the customer expressly agrees to it.
